The purpose of these General Terms of Use (hereinafter, “Conditions”) is to regulate access to and the use of the Website. For the purposes of these Conditions, the Website shall be understood to mean: the external appearance of the screen interfaces, both statically and dynamically, i.e., the navigation tree; and all elements integrated into the screen interfaces and the navigation tree (hereinafter, “Content”) and all those online services or resources that may be offered to Users (hereinafter, “Services”).

Student Houses reserves the right to modify, at any time and without prior notice, the presentation and configuration of the Website and the Content and Services that may be incorporated into it. The User acknowledges and accepts that Student Houses may at any time interrupt, deactivate, and/or cancel any of these elements integrated into the Website or access to them.

The access to the Website by the User is free and, as a general rule, free of charge, without the User having to provide any consideration to enjoy it, except for the cost of connection through the telecommunications network supplied by the access provider contracted by the User.

The use of certain Content or Services of the Website may require the prior subscription or registration of the User.

The User

Accessing, browsing, and using the Website confers the condition of User, by which all the Conditions set out herein, as well as any subsequent modifications, are accepted from the moment the User begins to browse the Website, without prejudice to the application of the corresponding legal regulations of mandatory compliance.

The Student Houses Website provides a wide variety of information, services, and data. The User assumes responsibility for the proper use of the Website. This responsibility shall extend to:

  1. A use of the information, Content, and/or Services and data offered by Student Houses without being contrary to the provisions of these Conditions, the Law, morality, or public order, or that in any other way could harm the rights of third parties or the same operation of the Website.
  2. The veracity and legality of the information provided by the User in the forms issued by Student Houses for access to certain Content or Services offered by the Website. The User must notify Student Houses immediately of any improper use of the registered information, such as theft, loss, or unauthorised access to identifiers and/or passwords, to proceed with their immediate cancellation.

Merely accessing this Website does not imply any kind of commercial relationship between Student Houses and the User.

The User declares to be of legal age and to have sufficient legal capacity to be bound by these Conditions. Therefore, this Student Houses Website is not directed at minors. Student Houses declines any responsibility for the breach of this requirement.

III. ACCESS AND NAVIGATION ON THE WEBSITE: EXCLUSION OF WARRANTIES AND LIABILITY

Student Houses does not guarantee the continuity, availability, and usefulness of the Website, nor of the Content or Services. Student Houses will do its best to ensure the proper functioning of the Website; however, it is not responsible, nor does it guarantee, that access to this Website will be uninterrupted or error-free.

Similarly, Student Houses does not assume any responsibility or guarantee that the content or software accessible through this Website is error-free or that it may cause damage to the User’s computer system (software and hardware). Student Houses shall not be liable for any losses, damages, or harms of any kind that arise from access, navigation, and use of the Website, including but not limited to damages to computer systems or those caused by the introduction of viruses.

Student Houses is also not responsible for damages caused to Users by improper use of this Website. In particular, Student Houses is not responsible for any service outages, interruptions, failures, or defects in telecommunications that may occur.

VIII. LEGAL ACTIONS, APPLICABLE LAW, AND JURISDICTION

Student Houses reserves the right to take any civil or criminal action it deems necessary for the improper use of the Website and Content, or for the breach of these Conditions.

The relationship between the User and Student Houses shall be governed by the regulations in force and applicable in the Spanish territory. Should any dispute arise in relation to the interpretation and/or application of these Conditions, the parties shall submit their conflicts to the ordinary jurisdiction, submitting to the judges and courts that correspond according to law.

IX. PAYMENT PLATFORM AND RESERVATION POLICY


Student Houses acts solely as a payment platform to facilitate the collection of the first monthly payment from tenants on behalf of third-party property owners or managers. This payment serves as a reservation fee and will be applied toward the tenant’s first month of rent if the lease agreement is successfully signed.

In the event that the lease agreement is not signed due to reasons attributable to the tenant (e.g., failure to provide required documentation, withdrawal from the rental process, or refusal to comply with agreed-upon terms), the reservation payment will not be refunded and will be forfeited as compensation for the inconvenience caused to the property owner or manager.
