I. PRIVACY POLICY AND DATA PROTECTION

In compliance with the applicable legislation, Student Houses (hereinafter referred to as the “Website”) commits to adopting the necessary technical and organisational measures, in line with the appropriate level of security for the risk associated with the data collected.

Laws Incorporated into This Privacy Policy

This privacy policy is adapted to the current Spanish and European regulations on the protection of personal data on the internet. Specifically, it complies with the following laws:

  • Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (GDPR).
  • Organic Law 3/2018, of 5 December, on the Protection of Personal Data and Guarantee of Digital Rights (LOPD-GDD).
  • Royal Decree 1720/2007, of 21 December, approving the Regulation for the development of Organic Law 15/1999, of 13 December, on the Protection of Personal Data (RDLOPD).
  • Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce (LSSI-CE).

Personal Data Register

In compliance with the provisions of the GDPR and LOPD-GDD, we inform you that the personal data collected by Student Houses through the forms provided on its pages will be incorporated into and processed in our files in order to facilitate, expedite, and fulfil the commitments established between Student Houses and the User, or to maintain the relationship established in the forms completed by the User, or to respond to a request or query. Furthermore, in accordance with the GDPR and LOPD-GDD, unless otherwise stated, a record of processing activities is maintained that specifies, according to its purposes, the processing activities carried out and other circumstances established by the GDPR.

Principles Applicable to the Processing of Personal Data

The processing of the User’s personal data will be subject to the following principles, as set out in Article 5 of the GDPR and Articles 4 and following of Organic Law 3/2018:

  • Principle of Lawfulness, Fairness, and Transparency: The User’s consent will be required at all times following fully transparent information about the purposes for which personal data is collected.
  • Principle of Purpose Limitation: Personal data will be collected for specific, explicit, and legitimate purposes.
  • Principle of Data Minimisation: Only the minimum personal data necessary for the purposes for which it is processed will be collected.
  • Principle of Accuracy: Personal data must be accurate and always kept up to date.
  • Principle of Storage Limitation: Personal data will only be retained for as long as necessary for the purposes of the processing.
  • Principle of Integrity and Confidentiality: Personal data will be processed in a manner that ensures its security and confidentiality.
  • Principle of Accountability: The Data Controller will be responsible for ensuring that the above principles are complied with.

Categories of Personal Data

The categories of data processed by Student Houses are solely identifying data. In no case are special categories of personal data processed within the meaning of Article 9 of the GDPR.

Legal Basis for Processing Personal Data

The legal basis for the processing of personal data is consent. Student Houses commits to obtaining the User’s express and verifiable consent for the processing of their personal data for one or more specific purposes.

The User will have the right to withdraw their consent at any time. It will be as easy to withdraw consent as it is to give it. As a general rule, withdrawal of consent will not condition the use of the Website.

In cases where the User must or can provide their data through forms to make enquiries, request information, or for reasons related to the content of the Website, they will be informed if the completion of any of these forms is obligatory due to their necessity for the proper development of the operation carried out.

Data Retention Periods

Personal data will only be retained for the minimum time necessary for the purposes of its processing and, in any case, only for the following period: until the User requests its deletion.

At the time personal data is obtained, the User will be informed about the period during which the personal data will be retained, or, when that is not possible, the criteria used to determine this period.

Recipients of Personal Data

The User’s personal data will be shared with the following recipients or categories of recipients:

If the Data Controller intends to transfer personal data to a third country or international organisation, the User will be informed at the time the personal data is obtained about the third country or international organisation to which it is intended to transfer the data, as well as about the existence or absence of a Commission adequacy decision.

Personal Data of Minors

Respecting the provisions of Articles 8 of the GDPR and 7 of Organic Law 3/2018, only those over 14 years of age may lawfully give their consent for the processing of their personal data by Student Houses. In the case of minors under 14 years of age, the consent of parents or guardians will be required, and processing will only be considered lawful if authorised by them.

Secrecy and Security of Personal Data

Student Houses commits to adopting the necessary technical and organisational measures, appropriate to the level of security risk of the data collected, to ensure the security of personal data and prevent its destruction, loss, or alteration, whether accidental or unlawful, as well as unauthorised communication of or access to such data.

However, because Student Houses cannot guarantee the absolute impregnability of the internet nor the complete absence of hackers or others who fraudulently access personal data, the Data Controller undertakes to notify the User without undue delay when a personal data breach occurs that is likely to result in a high risk to the rights and freedoms of individuals.

Following the provisions of Article 4 of the GDPR, a breach of personal data security means any breach of security that leads to the accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to personal data transmitted, stored, or otherwise processed.

Personal data will be treated as confidential by the Data Controller, who commits to informing and guaranteeing by legal or contractual means that such confidentiality is respected by their employees, associates, and any person to whom the information is made accessible.

Rights Arising from the Processing of Personal Data

The User may exercise the following rights recognised in the GDPR and Organic Law 3/2018 regarding the processing of personal data:

  • Right of Access: The User has the right to obtain confirmation as to whether Student Houses is processing their personal data and, if so, to obtain information about their specific personal data and the processing Student Houses has carried out or is carrying out, as well as, among other things, information available about the origin of said data and the recipients of the communications made or planned for them.
  • Right to Rectification: The User has the right to have their personal data modified if it proves inaccurate or, considering the purposes of the processing, incomplete.
  • Right to Erasure (“Right to be Forgotten”): The User has the right, provided that the current legislation does not state otherwise, to obtain the erasure of their personal data when it is no longer necessary for the purposes for which it was collected or processed; the User has withdrawn their consent to the processing and there is no other legal ground for processing; the User objects to the processing and there is no legitimate ground for continuing the processing; the personal data has been unlawfully processed; the personal data must be erased in compliance with a legal obligation; or the personal data has been obtained as a result of an offer of information society services to a minor under 14 years of age. In addition to erasing the data, the Data Controller, considering the available technology and the cost of implementation, must take reasonable steps to inform other controllers processing the personal data of the data subject’s request to erase any link to that personal data.
  • Right to Restriction of Processing: The User has the right to restrict the processing of their personal data. The User has the right to obtain restriction of processing when they contest the accuracy of their personal data; the processing is unlawful; the Data Controller no longer needs the personal data, but the User needs it to make claims; and when the User has objected to the processing.
  • Right to Data Portability: In the event that the processing is carried out by automated means, the User has the right to receive from the Data Controller their personal data in a structured, commonly used, and machine-readable format, and to transmit it to another controller. Whenever technically possible, the Data Controller will directly transmit the data to that other controller.
  • Right to Object: The User has the right to object to the processing of their personal data or to cease the processing of such data by Student Houses.
  • Right Not to be Subject to Automated Decision-Making, including Profiling: The User has the right not to be subject to an individualised decision based solely on automated processing of their personal data, including profiling, unless otherwise provided for by applicable law.

  • Name and surname of the User and a copy of the User’s ID. In cases where representation is accepted, it will also be necessary to identify by the same means the person representing the User, as well as the document proving representation. The photocopy of the ID may be replaced by any other valid means in law that proves identity.
  • The request specifying the particular reason for the request or the information to which access is sought.
  • Address for notifications.
  • Date and signature of the applicant.
  • Any document that proves the request made.

The Website may include hyperlinks or links that allow access to websites of third parties other than Student Houses, and which are therefore not operated by Student Houses. Complaints to the Supervisory Authority

In the event that the User considers that there is a problem or breach of the applicable regulations in the way their personal data is being processed, they will have the right to effective judicial protection and to file a complaint with a supervisory authority, particularly in the Member State where they have their habitual residence, place of work, or place of the alleged infringement. In the case of Spain, the supervisory authority is the Spanish Data Protection Agency (http://www.agpd.es).


II. COOKIE POLICY

Access to this Website may involve the use of cookies. It is necessary that the User has read and agrees with the conditions regarding the protection of personal data contained in this Privacy Policy and Cookies Policy, as well as that they accept the processing of their personal data so that the Data Controller can proceed with the same in the form, during the periods, and for the purposes stated. Use of the Website implies acceptance of its Privacy Policy and Cookies Policy.

Student Houses reserves the right to modify its Privacy Policy and Cookies Policy, according to its own criteria, or motivated by legislative, jurisprudential, or doctrinal changes of the Spanish Data Protection Agency. Changes or updates to this Privacy Policy and Cookies Policy will be explicitly notified to the User.


This Privacy Policy and Cookies Policy was updated on 7th October 2024 to comply with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 and Organic Law 3/2018, of 5 December, on the Protection of Personal Data and Guarantee of Digital Rights.
